Absence of nullity of the arbitration award on account of the failure to notify the mortgage creditor. Such creditor may be notified ten days prior to the alienation, pursuant to Article 698 of the CPC, such notice being required solely to validate the alienation carried out at public auction, given that the encumbrance attaches to the price, with real subrogation taking effect:
