Dismissal of the lawsuit without adjudication on the merits in view of the existence of an arbitration award. The party that caused the continuation of the proceedings by failing to disclose the prior existence of an arbitration award must bear the court costs and forfeit the right to recover attorneys' fees from the opposing party, even having prevailed on the merits:
