Where there is a request for annulment of clauses of a court-approved settlement in which the arbitration clause was established, the party may seek its nullity directly before the judiciary without the need to initiate arbitration proceedings for that purpose, according to a systematic interpretation of Articles 20, §2º, 32, I, and 33 of the Brazilian Arbitration Act:
