The arbitration clause must be clear in expressing the intent to exclude the jurisdiction of the judiciary for the resolution of the dispute. The clause providing that "Senior Executives shall be designated to seek a resolution of the dispute" does not constitute an arbitration clause, as they are not clearly designated as arbitrators, and is to be interpreted as a conciliation clause:
