The Superior Court of Justice (STJ)'s guidance regarding contracts for the sale of real property to end consumers is that such contracts constitute consumer adhesion contracts and that, accordingly, the effectiveness of the arbitration clause would be conditioned upon: "(i) the consumer's initiative in instituting the arbitration, or (ii) if instituted by the supplier, the consumer's express agreement, ratifying it":
