The execution of a debt settlement, by means of arbitral terms of reference, between the creditor and a third party not forming part of the contractual relationship, transfers the original debt to such third party, excluding the principal debtors, so that any enforcement of the arbitration award must be brought against the third party that assumed the debt.:
