The amendment of the conclusion of the court of origin regarding the existence of prejudice in connection with the failure to appoint an arbitrator by the respondent cannot be reviewed in a special appeal, as it would require re-examination of the factual and evidentiary content and of contractual clauses, which is prohibited under prevailing precedents No. 5 and 7 of the Superior Court of Justice (STJ):
