Arbitration award that does not award fees to the prevailing party. No compensation for material damages arising from the costs of the arbitration proceedings is available, as such costs are inherent to the exercise of the right of defense. Modifying this understanding would entail a reexamination of the factual and evidentiary record of the case, which is precluded by Prevailing precedents 5 and 7 of the Superior Court of Justice (STJ):
