Absence of a conflict of jurisdiction. The arbitration agreement does not constitute an impediment to the commencement of court-supervised reorganisation proceedings before the judiciary. Arbitration proceedings are purely evidentiary in nature and cannot affect the assets of the debtor undergoing reorganisation, which may only be subject to levy in aid of execution after review and approval by the reorganisation court:
