It is not possible to invoke before the judiciary the partiality of the arbitration center or of the arbitrator. Partiality may only be examined after an act has been performed that constitutes it. Furthermore, there is no record of any arbitrator challenge procedure having taken place, pursuant to Article 16 of the Brazilian Arbitration Act:
